1. Introduction
Beyond Health & Pharmacy ("Beyond Health," "we," "us," or "our") owns and operates the website located at beyondhealth.ca and any related mobile applications, pharmacy portal, and clinical care portal (collectively, the "Platform"). Beyond Health is a licensed Canadian compounding pharmacy serving patients across Canada from our locations in Abbotsford and Surrey, British Columbia.
This Privacy Policy explains how Beyond Health collects, uses, discloses, and protects personal information about you when you interact with us, including when you use the Platform and any related content, products, or services provided through the Platform or otherwise by Beyond Health (collectively, the "Service"). The Service includes online health assessments, prescription review by licensed healthcare practitioners, custom-compounded medications, prescription refills and transfers, and discreet home delivery.
Beyond Health engages licensed healthcare practitioners (collectively, "Healthcare Providers") to review patient assessments, issue prescriptions where clinically appropriate, and provide follow-up clinical support. In the provinces and territories where we operate, Beyond Health is directly accountable for protecting the privacy of your health information, including information about your health history, treatment, payments, or eligibility for healthcare, and any other information collected in the course of providing you with healthcare. Where a Healthcare Provider in your jurisdiction is independently accountable for your health information under applicable law, Beyond Health may collect, use, and disclose that information on the Healthcare Provider's behalf, as described in this Privacy Policy, to assist them in delivering the Service to you.
We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA), British Columbia's Personal Information Protection Act (PIPA BC), and any other applicable provincial or territorial privacy and health information laws.
2. Collection and Use of Personal Information
The personal information we collect depends on how you interact with us, which parts of the Service you use, and the choices you make. We collect personal information from different sources and in various ways, including information you provide directly, information collected automatically, information from third-party sources, and information we infer or generate from other data.
We use the personal information we collect for the purposes described below or as otherwise disclosed to you at the time of collection.
Information you provide directly
Name and identity information (e.g., name, email address, phone number, billing and shipping addresses, date of birth, and government-issued identifiers such as your provincial health card number or driver's licence number where required for verification).
How we use this information:
- To create and manage your account.
- To verify your identity before issuing a prescription or shipping medication.
- To deliver prescribed medications and health-related products to your physical address.
- To process billing, insurance claims, and issue receipts.
- To contact you about your assessment, prescription, refill, or follow-up care.
- To provide customer and pharmacy support and respond to your inquiries.
- To send you transactional communications, including order confirmations, shipping updates, refill reminders, technical notices, and security alerts.
- With your consent, to send you information about new services, promotions, and educational health content.
Health information (e.g., information about your physical and mental health, current and previous healthcare providers, medical history, allergies, diagnoses, treatments, medications, lab results, referral notes, substitute decision-makers, and your provincial health card number).
How we use this information:
- To provide healthcare assessment, treatment, and related pharmacy services, including custom compounding.
- To coordinate and manage your care, inform you of treatment alternatives, and provide refill management.
- To bill and collect payment from you, an insurance company, a government program (such as the BC PharmaCare program), or another third-party payer.
- To review the credentials, qualifications, and clinical decisions of our Healthcare Providers and pharmacists for quality assurance.
- To meet our regulatory recordkeeping obligations to the College of Pharmacists of British Columbia and other applicable regulators.
Demographic data (e.g., gender, date of birth, sex assigned at birth).
How we use this information:
- To provide clinically appropriate healthcare and tailored treatment recommendations.
Payment information (e.g., credit card number, financial account information, insurance plan details).
How we use this information:
- For billing, processing your payments, and accounting.
- To submit claims to insurance providers or government drug benefit programs on your behalf when authorized.
Payment card information is processed by PCI-DSS compliant third-party payment processors. We do not store complete credit card numbers on our own systems.
Content and files (e.g., photographs, videos, documents, lab results, and other files you upload, including messages and other communications you send to us or your Healthcare Provider).
How we use this information:
- To allow your Healthcare Provider to review medical documents, test results, or clinical photos.
- To store secure communications between you and your Healthcare Provider for continuity of care.
- To track and respond to inquiries regarding consultations, prescriptions, or pharmacy advice.
Account access information (e.g., username, password, security code, or other credential that allows access to your account).
How we use this information:
- To provide secure access to your account and health records.
- To protect your information from unauthorized access.
- To detect and prevent fraudulent activity.
Information we collect automatically
Identifiers and device information (e.g., IP address, device identifiers, device type, operating system, browser type and version, language, and configuration).
How we use this information:
- To deliver and troubleshoot the Service.
- To maintain the security of your session and prevent unauthorized access.
- To optimize Platform performance and reliability.
Geolocation data (e.g., general location derived from your IP address or device settings).
How we use this information:
- To confirm that the Service is available in your province or territory.
- To connect you with Healthcare Providers and pharmacists licensed in your jurisdiction.
Usage data (e.g., the URL you came from, pages you viewed, time spent on each page, access times, and other details about your interactions with the Platform).
How we use this information:
- To understand how patients use the Platform and to improve the Service.
- To measure the effectiveness of our content and educational materials.
- To develop, test, and improve features.
Information we create or generate
We infer new information from data we collect, such as your general geographic location based on your IP address, or eligibility for certain treatments based on your assessment responses.
How we use this information:
- To recommend Healthcare Providers, treatments, or compounded formulations that may be appropriate for you.
- To identify patterns in patient needs and improve clinical workflows.
Information from third-party sources
We may also receive personal information about you from third parties, including:
- Other healthcare providers, pharmacies, or labs involved in your care, with your consent or as permitted by law.
- Insurance providers and government drug benefit programs for the purpose of coverage verification and claims adjudication.
- Service providers that perform work on our behalf, such as identity verification, fraud prevention, shipping, or analytics.
- Publicly available sources such as professional licensing registries.
De-identified information
We may de-identify personal information and use it for research, quality improvement, analytics, or other purposes not prohibited by applicable law. When information is de-identified, we will not attempt to re-identify it except to test the effectiveness of the de-identification process or as otherwise permitted by law.
3. Cookies, Mobile IDs, and Similar Technologies
We use cookies, web beacons, mobile analytics IDs, and similar technologies on the Platform to operate the Service and to help us collect usage data, identifiers, and device information.
Cookies are small text files stored by your browser on your device. Web beacons are small electronic images embedded in web pages or emails that allow us to record certain interactions. Mobile analytics IDs are generated by mobile operating systems and used by apps in a similar way to cookies.
We use these technologies to:
- Keep you signed in to your account.
- Remember your preferences and settings.
- Maintain session security and detect fraud.
- Analyze how the Platform performs so we can improve it.
- Where you have provided consent, deliver and measure relevant marketing.
We do not use sensitive health information for behavioural advertising or third-party marketing.
You can control cookies through your browser settings. Most browsers allow you to refuse new cookies, delete existing cookies, or be notified when new cookies are set. Mobile operating systems (iOS and Android) also offer settings that limit ad tracking or reset advertising IDs. Disabling cookies may affect the functionality of the Platform, including your ability to sign in or complete an assessment.
4. Disclosure of Personal Information
We disclose personal information only as needed to provide the Service, as authorized by you, or as permitted or required by law. We may disclose the categories of personal information described above to the following types of recipients:
- Healthcare Providers and pharmacists. We share your assessment, health information, and prescription information with the licensed Healthcare Providers and pharmacy staff involved in your care.
- Other pharmacies and labs. With your consent or as permitted by law, we may share information with other pharmacies (for example, to transfer a prescription) or with labs that perform testing on your behalf.
- Insurers and government drug benefit programs. Where you ask us to submit a claim or verify coverage, we share the information required to process that claim.
- Couriers and shipping partners. We share your name, shipping address, and order details with our shipping partners so we can deliver your medication in discreet, plain packaging.
- Payment processors and financial institutions. We share payment and transaction data with PCI-DSS compliant payment processors and banks as needed to process payments, prevent fraud, and reconcile accounts.
- Service providers. We use vetted service providers for hosting, data storage, IT and security, identity verification, customer support, analytics, fraud prevention, and similar purposes. These service providers are bound by contractual obligations to keep your information confidential and to use it only for the purposes we authorize.
- Affiliates. We may share information with our corporate affiliates and related entities where doing so helps us operate the Service and where the same privacy protections apply.
- Regulators and legal authorities. We will disclose personal information where required by law, including to provincial pharmacy regulators, public health authorities, courts, or law enforcement responding to valid legal process.
- Corporate transactions. If Beyond Health is involved in a merger, acquisition, financing, reorganization, sale, or other corporate transaction, personal information may be transferred as part of that transaction, subject to applicable privacy law.
- To protect rights and safety. We may disclose personal information where we believe it is necessary to prevent fraud, protect the safety of our patients or staff, secure our systems, or enforce our agreements.
Service providers outside Canada
Some of our service providers may be located outside of British Columbia or outside of Canada. While your personal information is outside of your province or territory, it may be subject to the laws of that jurisdiction, which may require disclosure to local authorities. We use contractual and technical safeguards to require these service providers to protect your personal information to a standard comparable to the protection it receives in Canada. 5. Your Consent
We collect, use, and disclose your personal information with your consent. Depending on the sensitivity of the information and the circumstances, your consent may be express (for example, agreeing to a telehealth consent form before an assessment) or implied (for example, providing your shipping address so we can deliver a medication you ordered). Generally, we will seek your consent at the time we collect your personal information.
In some circumstances, we may collect, use, or disclose your personal information without your consent as permitted or required by law (for example, to comply with a court order, to investigate suspected fraud, or where another exception under PIPEDA or PIPA BC applies).
If you provide personal information about another individual to us (such as a dependant or substitute decision-maker), you confirm that you have the authority to do so and have obtained any necessary consent.
You may withdraw your consent to our continued collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may mean that we can no longer provide you with certain products or parts of the Service.
6. Personal Information About Minors
The Service is intended for individuals who can lawfully consent to healthcare in their province or territory. Where we provide the Service to a minor who is capable of consenting to the collection, use, or disclosure of their personal information under applicable law, we may obtain consent directly from the minor. In other cases, we obtain consent from a parent or legal guardian.
The Service is not directed to children under 14 years of age. If we become aware that we have collected personal information from a child under 14 without appropriate consent, we will take reasonable steps to delete that information.
7. Your Privacy Rights
Subject to applicable law, you have the following rights with respect to your personal information:
- Right to access. You can ask us to confirm what personal information we hold about you and how we have used and disclosed it.
- Right to correct or update. You can ask us to correct personal information that is inaccurate, incomplete, or out of date. Where appropriate, we will share corrected information with third parties to whom we previously disclosed it.
- Right to withdraw or limit consent. You can withdraw or place conditions on your consent, subject to legal and contractual limits.
- Right to delete. You can ask us to delete personal information, subject to our regulatory obligation to retain pharmacy and clinical records for the time periods required by law.
- Communication preferences. You can unsubscribe from marketing emails or SMS at any time using the unsubscribe link or reply instructions in the message. We will still send you transactional and clinical messages that are necessary to deliver the Service.
To exercise any of these rights, contact us using the details in the "Contacting Us" section. We may require that you verify your identity before responding to your request, and we will respond within the timelines required by applicable law.
8. Retention of Personal Information
We retain personal information for as long as necessary to provide the Service and to comply with our legal, regulatory, accounting, and reporting obligations. Pharmacy and clinical records are retained for the minimum periods required by the College of Pharmacists of British Columbia, provincial health regulators, and other applicable laws. When personal information is no longer required, we securely destroy, erase, or de-identify it.
9. Protection of Personal Information
Beyond Health takes the privacy and security of your personal information seriously. We use a combination of physical, technical, and administrative safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, loss, or destruction. Our safeguards include:
- Encryption in transit. All communications between your browser or device and our Platform are protected using industry-standard HTTPS with TLS (Transport Layer Security) encryption. This protects your information while it travels over the internet so that it cannot be read or tampered with by third parties.
- Encryption at rest. Personal information and health information stored in our databases, file storage, and backups is encrypted at rest using strong, industry-standard encryption (such as AES-256). Encryption keys are managed separately from the data they protect and access to keys is tightly restricted.
- LegitScript certification. Beyond Health is a LegitScript-certified online pharmacy. LegitScript independently verifies that we operate in compliance with all applicable laws and regulations, including licensing, prescription requirements, and patient safety standards. You can verify our certification using the LegitScript seal shown on our website.
- Licensed Canadian pharmacy. Beyond Health is a licensed pharmacy operating under the regulatory oversight of the College of Pharmacists of British Columbia, which sets and enforces standards for the handling and confidentiality of patient information.
- Access controls and authentication. Access to personal information is restricted to authorized Beyond Health staff, Healthcare Providers, and service providers who need it to perform their duties. Internal access is protected by individual user accounts, role-based permissions, strong password requirements, and multi-factor authentication for sensitive systems.
- Network and infrastructure security. Our systems are hosted in secure, access-controlled facilities and protected by firewalls, intrusion detection, vulnerability scanning, and continuous monitoring.
- Discreet packaging. All medications ship in plain, unbranded packaging so that the contents of your order are not visible to anyone other than you.
- Staff training and confidentiality. All Beyond Health personnel receive privacy and security training and are bound by confidentiality obligations as a condition of their work.
- Vendor due diligence. Service providers that handle personal information on our behalf are contractually required to maintain safeguards comparable to ours and to use the information only for authorized purposes.
- Incident response. We maintain procedures to detect, investigate, and respond to privacy incidents and security breaches, and we will notify affected individuals and regulators where required by law.
No method of transmission over the internet or method of electronic storage is 100% secure. While we use reasonable safeguards designed to protect your personal information, we cannot guarantee absolute security. You also play an important role in keeping your information safe. Please choose a strong, unique password for your account, do not share your password or sign-in codes with anyone, and notify us immediately if you suspect that your account has been compromised.
10. Updates to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this Policy and post the updated version on the Platform. Material changes will be communicated to you in accordance with applicable law. Your continued use of the Service after the updated Policy takes effect constitutes your acceptance of the changes.

These Terms and Conditions (the "Terms") govern your access to and use of the websites, mobile applications, pharmacy portal, clinical portal, software, communications, and any other product or service offered by Beyond Health & Pharmacy ("Beyond Health," "we," "us," or "our") (collectively, the "Services"). In these Terms, "you" and "your" refer to the person using the Services.
Your access to and use of the Services is subject to these Terms, our Privacy Policy (above), any telehealth consent form you may be asked to sign, and all applicable laws and regulations. Certain parts of the Services may also be governed by additional or supplementary terms, which will be presented to you in context and which you agree to review and be bound by.

1. Overview
About the Services. The Services may include: (i) providing patients with information about health, wellness, and compounded medications; (ii) operating a licensed Canadian compounding pharmacy that fills, packages, and ships prescription products via courier across Canada; (iii) facilitating online health assessments and clinical intake; (iv) collecting and maintaining health information and pharmacy records for use in clinical reviews, refills, and follow-up care; (v) administrative support for scheduling, billing, insurance claims, and government drug benefit program coordination; and (vi) telecommunications tools that allow you to communicate with Healthcare Providers and Beyond Health pharmacy staff.
Availability. The Services are intended for use only by persons located in Canada. Certain Services or compounded products may only be available in certain provinces or territories depending on licensing, regulatory approvals, and product eligibility. If you access the Services from outside Canada, you do so at your own risk and are solely responsible for compliance with local laws.
Eligibility. The Services are intended for individuals who are 18 years of age or older, or, where applicable, mature minors who are legally capable of consenting to their own healthcare. To use the Services, you represent and warrant that:
- You are 18 years of age or older, or you have the express consent of a parent or legal guardian where required by law.
- You are located in a Canadian province or territory where the Services you are requesting are available.
- The information you provide to us is true, accurate, and complete.
- You agree to comply with these Terms.
Meeting these requirements does not guarantee that you will receive any specific Service. Beyond Health and its affiliated Healthcare Providers reserve the right to decline to provide a Service, change requirements, or modify product availability at any time in their sole discretion.
2. Our Services
Your relationship with Beyond Health. Beyond Health is a licensed Canadian pharmacy. Beyond Health itself does not practice medicine. Independent licensed healthcare practitioners, including physicians and nurse practitioners ("Healthcare Providers"), provide clinical services such as assessment review, diagnosis, and prescription decisions ("Healthcare Services") through the Platform. The Healthcare Providers, and not Beyond Health, are responsible for the clinical appropriateness of the Healthcare Services they provide to you.
The health information made available through the Services is for educational purposes only and is not a substitute for in-person medical care in all cases. The decision about diagnosis and treatment rests with you and your Healthcare Provider. By using the Services, you are not entering into a provider-patient relationship with Beyond Health itself; your provider-patient relationship is with the Healthcare Provider who reviews your assessment.
You agree that any prescription written by a Healthcare Provider is solely for the personal use of the individual named on the prescription. You agree to carefully read all product information, labels, and pharmacist counselling materials, and to contact your Healthcare Provider or our pharmacy team if you have any questions about your prescription or medication.
You should report any medication reactions, side effects, or other adverse events to your Healthcare Provider, the Beyond Health pharmacy team, or your nearest walk-in clinic or emergency department, and call 911 if any reaction is an emergency.
Except for communications received directly from a Healthcare Provider or one of our pharmacists, none of the information you receive through the Services should be considered personal medical advice.
Telehealth Services. Telehealth involves the delivery of healthcare services using electronic communication and information technology when the patient and Healthcare Provider are not in the same physical location. Telehealth may include:
- Electronic transmission of medical records, photos, personal health information, or other data between you and your Healthcare Provider;
- Asynchronous or synchronous communication between you and your Healthcare Provider via secure messaging, audio, or video;
- The use of clinical questionnaires, lab results, or other clinical data to support diagnosis and treatment.
The electronic systems used in the Services include network and software security protocols designed to protect the privacy and security of your health information, as further described in our Privacy Policy. By accepting these Terms, you consent to receive disclosures, notices, messages, prescription information, and other communications from Beyond Health and your Healthcare Provider electronically, including through your account or by email. It is your responsibility to monitor these communications. You acknowledge that no method of electronic transmission can be guaranteed to be 100% secure.
Pharmacy Services. If you receive a prescription as a result of your use of the Services, you may choose to have it filled by the Beyond Health compounding pharmacy or transferred to another pharmacy of your choice. If you choose Beyond Health, you authorize us to receive your prescription, compound and dispense your medication, package it discreetly, and ship it to the address you provide. Most compounded medications are shipped free of charge across Canada; shipping fees, taxes, or insurance copayments may apply depending on the product and your coverage.
You acknowledge that certain compounded medications may not be shipped in child-resistant packaging and that you are responsible for storing them safely and out of the reach of children and pets. You also agree to follow all dosing instructions provided by the Healthcare Provider and the pharmacist.
3. Registration and Account Creation
Some parts of the Services are accessible without an account, but you must create an account to complete an assessment, receive a prescription, manage refills, or use the pharmacy portal. When you create an account, you agree to:
- Provide accurate, complete, and current information about yourself.
- Keep your information up to date.
- Keep your username, password, and any sign-in codes confidential and to sign out at the end of each session.
- Be responsible for all activity that takes place under your account.
- Immediately notify Beyond Health if you become aware of any unauthorized use of your account or any other breach of security by emailing us at the address in the "Contact Us" section.
You may not transfer or share your account, create more than one account, or use someone else's account. Beyond Health may suspend or terminate your account if we have reasonable grounds to believe you have violated these Terms or that your account information is inaccurate.
4. Ownership and License to Use the Services
Ownership. As between you and Beyond Health, Beyond Health is the sole owner of all right, title, and interest in and to the Services and their content, features, and functionality, including all information, software, text, images, video, audio, design, selection, arrangement, and look and feel (collectively, the "Services Content"). All trademarks, logos, service marks, and trade names displayed on or through the Services (the "Marks") are owned by Beyond Health or its licensors. You may not use any Marks without our prior written consent.
You may not reproduce, publish, distribute, modify, reverse engineer, disassemble, create derivative works of, publicly display, republish, store, transmit, sell, or otherwise exploit any portion of the Services or Services Content except as expressly permitted by these Terms.
Your License. Subject to your compliance with these Terms, Beyond Health grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Services and Services Content solely for your personal, non-commercial use. All rights not expressly granted are reserved.
5. User Content
Subject to our Privacy Policy and applicable health information privacy laws, any information you submit through the Services that is not personal health information or otherwise protected by law (including questions, comments, feedback, suggestions, and forum posts) ("User Content") will be treated as non-confidential and non-proprietary. You grant Beyond Health a worldwide, royalty-free, fully transferable, and sublicensable right to use, reproduce, modify, display, distribute, and disclose such User Content to operate, improve, and promote the Services, conduct research and analytics, and develop new products and features, without compensation to you. You waive any moral rights in such User Content to the extent permitted by law.
Beyond Health does not assume responsibility or liability for User Content posted in any public forum or for any claims, damages, or losses resulting from public forum content.
You acknowledge and agree that Beyond Health may access, monitor, preserve, and disclose information about your account, your communications, or your User Content if we believe in good faith that doing so is permitted by law and reasonably necessary to: (1) comply with legal process; (2) enforce these Terms or our Privacy Policy; (3) respond to claims that content infringes third-party rights; (4) respond to your requests for customer or pharmacy support; or (5) protect the rights, property, or safety of Beyond Health, our patients, our staff, or the public.
6. Privacy
Beyond Health takes the confidentiality and security of your personal information and health information seriously. Our Privacy Policy (above) describes how we collect, use, disclose, and protect your information, including details about the encryption, access controls, and other safeguards we use. The Privacy Policy is incorporated into these Terms by reference.
7. Restrictions on Use
You agree that you will not, and will not attempt to:
- impersonate any person or entity or misrepresent your affiliation with a person or entity;
- violate any local, provincial, federal, or international law;
- reverse engineer, disassemble, decompile, or translate any software or other component of the Services;
- distribute, upload, transmit, or run any virus, worm, Trojan horse, or other malicious code that could damage or alter the Services or any device, network, or data;
- infringe, misappropriate, or otherwise violate any intellectual property right or other right of any third party;
- use any robot, spider, scraper, or other automated means to access the Services without our prior written permission;
- license, sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Services, Services Content, or User Content;
- use the Services to create or develop a competing product or service;
- damage, disrupt, overburden, or interfere with the Services;
- frame, mirror, or otherwise enclose any portion of the Services without our prior written consent;
- post or transmit any content that is unlawful, harmful, harassing, fraudulent, threatening, abusive, defamatory, obscene, hateful, discriminatory, or otherwise objectionable, or that incites violence or harms minors;
- harass, threaten, abuse, defame, or discriminate against any Healthcare Provider, pharmacist, or Beyond Health staff member;
- bypass, breach, or otherwise circumvent any security measure, authentication mechanism, or technological protection used by Beyond Health or our service providers;
- remove or obscure any copyright, trademark, or other proprietary notices from the Services;
- send any unsolicited advertising, "junk mail," chain letters, or spam through the Services; or
- encourage or assist any third party to do any of the above.
8. Disclaimer
YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BEYOND HEALTH AND ITS AFFILIATES, LICENSORS, HEALTHCARE PROVIDERS, AND SERVICE PROVIDERS, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS (COLLECTIVELY, "RELATED PERSONS") DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AVAILABILITY, SECURITY, ACCURACY OF DATA, AND FREEDOM FROM VIRUSES OR MALWARE.
BEYOND HEALTH DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM DEFECTS, DELAYS, CORRUPTION, CYBER ATTACK, OR OTHER SECURITY INTRUSIONS. YOU ARE RESPONSIBLE FOR EVALUATING THE ACCURACY, COMPLETENESS, TIMELINESS, AND USEFULNESS OF ANY CONTENT MADE AVAILABLE THROUGH THE SERVICES. ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH THE SERVICES IS USED AT YOUR OWN RISK.
NOTHING IN THESE TERMS IS INTENDED TO EXCLUDE OR LIMIT ANY WARRANTY OR LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
9. Limitation of Liability
CERTAIN JURISDICTIONS, INCLUDING THE PROVINCE OF QUEBEC, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BEYOND HEALTH OR ITS RELATED PERSONS BE LIABLE TO YOU OR ANY THIRD PARTY UNDER ANY LEGAL OR EQUITABLE THEORY (INCLUDING NEGLIGENCE, STRICT LIABILITY, CONTRACT, WARRANTY, OR STATUTE) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE OR DATA, SERVICE INTERRUPTION, DEVICE DAMAGE, OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF BEYOND HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL BEYOND HEALTH'S OR ITS RELATED PERSONS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE GREATER OF (I) ONE HUNDRED CANADIAN DOLLARS (CAD $100), OR (II) THE AMOUNT YOU PAID TO BEYOND HEALTH FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS LIMITS OR EXCLUDES BEYOND HEALTH'S LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
10. Indemnification
You agree to indemnify, defend, and hold harmless Beyond Health, its affiliates, Healthcare Providers, and all of their directors, officers, employees, contractors, licensors, suppliers, representatives, and agents from and against any and all third-party claims, actions, proceedings, damages, settlements, judgments, liabilities, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (i) your use of the Services in an unauthorized manner; (ii) your fraud, violation of law, negligence, or wilful misconduct; or (iii) your breach of these Terms.
11. Third-Party Links and Features
The Services may contain links, plug-ins, products, or features operated by third parties ("Third-Party Services"). Beyond Health does not control Third-Party Services and is not responsible for their content, products, security, or privacy practices. Your use of Third-Party Services is at your own risk and is governed by the terms and privacy policies of the third party. The inclusion of a Third-Party Service does not imply endorsement by Beyond Health.
Beyond Health is not a party to any transaction between you and a third party (including transactions with shipping carriers or pharmacy partners other than Beyond Health), and will not be involved in resolving disputes between you and such third parties.
12. Changes to the Terms and the Services
Not applicable to Quebec consumers. Beyond Health reserves the right to modify these Terms at any time in its sole discretion. We will update the "Last updated" date when we do. Material changes will be communicated as required by applicable law. Your continued use of the Services after the updated Terms take effect constitutes your acceptance of the changes. If you disagree with the updated Terms, your sole remedy is to stop using the Services.
You acknowledge that: (1) all or part of the Services may be unavailable at any time for any reason; and (2) Beyond Health will not be liable if the Services are unavailable. Beyond Health reserves the right to modify, suspend, or permanently discontinue the Services or any portion of them, with or without notice.
Applicable to Quebec consumers. Beyond Health will provide email notification to Quebec consumers 30 days before any material modifications to these Terms take effect, sent to the email address on file in your account. If you disagree with the modifications, you may terminate your subscription at any time before the changes take effect, without penalty.
13. Payments, Subscriptions, and Refunds
Payment processing. We do not store complete credit card numbers on our own systems. All payments for the Services are processed by PCI-DSS compliant third-party payment processors. All transactions are denominated in Canadian dollars unless otherwise stated, and are subject to any applicable taxes.
Subscriptions and auto-refills. Certain Services, including prescription auto-refill plans for compounded medications, may be offered on a recurring basis. Before you enrol in a recurring plan, we will clearly display: (a) the price for the plan; (b) the billing frequency; (c) any applicable taxes and shipping fees; and (d) the start date. By providing your payment information and confirming your enrolment, you authorize our payment processor to automatically charge your selected payment method at the beginning of each billing period until you cancel in accordance with these Terms.
You are responsible for keeping your payment information valid and up to date. If a payment cannot be processed, we may suspend or restrict your access to the affected Services until a valid payment method is provided and the outstanding amount is paid.
Refunds. Except as required by applicable law (including consumer protection law in Quebec), all payments for compounded medications and pharmacy services are final and non-refundable once the medication has been dispensed, because compounded prescriptions cannot be resold or reused for safety reasons. We will work with you in good faith to resolve any billing errors and may issue a credit or refund where appropriate.
For Quebec consumers, where a refund is required by law, it will be calculated on a prorated basis for the unused portion of the Service.
14. Termination
These Terms remain in effect for as long as you continue to access or use the Services. You may terminate these Terms at any time by discontinuing your use of the Services and, where applicable, cancelling your account or any subscription through your account settings or by contacting us.
Beyond Health may suspend or terminate your access to the Services without prior notice if you violate these Terms, fail to maintain accurate account information, or for any other reason where we reasonably believe suspension or termination is necessary to protect patients, staff, or the integrity of the Services. We may also terminate these Terms or the Services for any reason on sixty (60) days' prior written notice.
The following sections survive termination of these Terms: Disclaimer, Limitation of Liability, Indemnification, Governing Law and Dispute Resolution, No Waiver, and Assignment.
Subject to applicable law, Beyond Health may maintain, archive, or delete records and communications related to your account in accordance with our retention policies and our regulatory obligations as a licensed pharmacy. After termination, Beyond Health will have no obligation to provide further Services, except to the extent your Healthcare Provider or our pharmacy is required by law, professional ethics, or regulation to provide you with continuing care or access to your health records.
15. Governing Law, Jurisdiction, and Dispute Resolution
This section is not applicable to Quebec consumers, where it would conflict with mandatory provisions of Quebec law.
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY. IT DESCRIBES HOW DISPUTES BETWEEN YOU AND BEYOND HEALTH WILL BE RESOLVED.
Governing law and jurisdiction. These Terms are governed by and interpreted under the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-laws principles. Subject to the dispute resolution provisions below, you and Beyond Health irrevocably submit to the exclusive jurisdiction of the courts of British Columbia for any dispute arising from or related to these Terms or the Services.
Dispute resolution.
a) You and Beyond Health agree to first attempt to resolve any dispute, claim, or controversy arising from or related to these Terms, any additional terms, or our Privacy Policy ("Disputes") through good-faith negotiation, after providing the other party with a written Notice of Dispute.
b) If we are unable to resolve the Dispute within 21 business days from the Notice of Dispute, the Dispute will be resolved by binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of its intellectual property rights or confidential information.
c) YOU AND BEYOND HEALTH MUST FILE A NOTICE OF DISPUTE FOR ARBITRATION WITHIN ONE YEAR FROM THE DATE THE MATTER FIRST AROSE; OTHERWISE NEITHER PARTY WILL BE ABLE TO INITIATE ARBITRATION OR SEEK LEGAL RECOURSE FOR THAT MATTER.
d) Arbitration will be administered by the British Columbia International Commercial Arbitration Centre (BCICAC) in accordance with its rules. The arbitration will be conducted in Vancouver, British Columbia, in the English language, by a single arbitrator. The arbitrator's award will be final and binding and may be entered in any court of competent jurisdiction.
This section survives any termination of your account or these Terms.
16. Communications by Text Message and Email
By providing your phone number or opting in to SMS messages from Beyond Health, you consent to receive text messages about your account, your assessment, your prescription, shipping updates, refill reminders, and other transactional matters, as well as promotional messages if you have opted in to those separately. Standard message and data rates from your carrier may apply.
You may opt out of marketing SMS messages at any time by replying STOP to the message you received from the mobile device subscribed to that service. After you send STOP, we may send a final confirmation message. Opting out of marketing messages does not opt you out of transactional or clinical messages necessary to provide the Services.
Email and SMS messages sent to or from Beyond Health are not always encrypted, and the transmission of information over the internet and mobile networks is not 100% secure. If you choose to send or receive sensitive health information by email or SMS, you do so at your own risk. By providing us with your email address or phone number, you consent to receive unencrypted emails and text messages from Beyond Health.

17. General
No waiver. A failure by Beyond Health to enforce any provision of these Terms is not a waiver of that provision or any other provision.
No agency. These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Beyond Health.
Remedies. You agree that a violation or threatened violation of these Terms may cause Beyond Health irreparable harm for which monetary damages would be inadequate, and you consent to injunctive or equitable relief in addition to any other remedies available at law or in equity.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent, and any attempted assignment is void. Beyond Health may assign these Terms in connection with a merger, acquisition, financing, sale of assets, or other corporate transaction.
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy and any telehealth consent or supplementary terms presented to you in connection with specific Services, constitute the entire agreement between you and Beyond Health regarding the Services and supersede all prior agreements and understandings, whether oral or written.
Language. The parties have requested that these Terms be drafted in English. Les parties ont expressément demandé que ces conditions soient rédigées en anglais.
